Seller Representations and Warranties seller represents and warrants to Buyer that (a) the dog is in good health and free of communicable diseases at time of sale. Purchaser has 48 hours from the pickup date to have the dog examined by a licensed veterinarian, at purchaser's sole cost. We will not pay for vet bills for any reason. If the puppy has not been to the vet within 48 hours of pickup date, this contract is null and void. If the dog fails the examination, the purchaser may return the dog, (at purchaser's sole cost) with a written statement from the veterinarian, for a replacement puppy only. In the event of death within the 48 hour period, autopsy must be performed (at buyers expense) to determine the cause of death. I, the seller, am not responsible for vet bills. If buyer chooses to keep the puppy, no replacement will be given, and all medical costs and treatment are sole responsibility of the buyer. (b) your puppy has been given its first puppy shot and has been wormed 3 times (shot/record book has been given to you). It is recommended that your puppy receives limited exposure, and a stool sample is examined. Do not take your puppy to dog parks/ pet stores until they have completed their series of shots. We have made every attempt to keep your puppy free of ear mites, mange mites, fleas or worms, however puppies cannot be safely treated until 12 weeks of age. If your puppy is found to have any of these pesky creatures, it is your sole responsibility to eradicate them. (c) this guarantee does not cover cherry eye, entropion, ectropion, allergies, undescended testicles, loose knees or hips, stenotic nares, elongated soft palate, umbilical hernia, dermatitis, demodectic mange. Seller will NOT replace or refund puppy due to heat stroke, abuse, neglect, allergies you or a family member may have to the puppy, or improper socialization. Buyer agrees that they have thoroughly researched the breed and understand the health issues they can possess.
If within the first year, the puppy is found by a certified vet to have a genetic disease, which will prevent the puppy from leading a normal healthy life, seller will replace the puppy with a puppy from a different litter. The sick puppy must be returned at buyers expense to the seller. No refunds will be given. Vet report must be available to seller before seller will replace the puppy. Buyer is responsible for all medical costs of their puppy. (NO refunds will be given) This guarantee covers ONLY the original Buyer and is not transferable! NO refunds will be given for any reason.
1. Indemnity and Release if any action or failure to act on the part of the Buyer shall result in any claim, suits, loss, damage, injury, death, or liability, buyer agrees to defend, indemnify, and hold seller harmless and to pay all of the sellers costs and expenses, including reasonable legal fees, and any amount paid into settlement and any award or judgement with respect thereto. Buyer releases Seller from any, and all liability, costs or damage caused by the dog after placement with the Buyer, including but not limited to, damage to or destruction of property, and injury to any person.
2. Limitation of action any action or claim brought by buyer against seller for breach of this agreement or for loss due to negligence must be brought within one year of the date such claim or loss occurs.
3. Governing law this agreement shall be governed by and constructed in accordance with the laws of Missouri.
The Buyers accept and agree to be bound by the attached terms and conditions governing the purchase and sale of the dog. This agreement represents the entire agreement, promises, representations or warranties, express or implied, unless specifically stated in this agreement. I acknowledge that I have received the dog into my possession.
